1. Agreement to Terms

By accessing or using PicGallery ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including photographers ("Photographers") and their clients ("Clients").

2. Description of Service

PicGallery is a photo gallery platform that enables photographers to:

• Upload and organize photos in galleries
• Share galleries with clients via secure links
• Enable clients to view, favorite, and download photos
• Manage photo delivery workflows
• Apply custom branding to galleries

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time through your account settings.

4. User Content

Ownership

You retain all rights to the content you upload to PicGallery, including photos, gallery descriptions, and other materials ("User Content"). We do not claim ownership of your User Content.

License to PicGallery

By uploading User Content, you grant PicGallery a non-exclusive, worldwide, royalty-free license to use, display, and transmit your User Content solely for the purpose of providing the Service. This license ends when you delete your User Content or account.

Content Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to upload the content
• Your content does not infringe any third party's intellectual property or privacy rights
• Your content does not contain illegal, harmful, or objectionable material
• You have obtained necessary consents from individuals depicted in photos

5. Prohibited Uses

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Upload content depicting minors in inappropriate situations
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for spam, phishing, or other fraudulent purposes
• Interfere with or disrupt the Service or servers
• Resell or redistribute the Service without authorization

6. Subscription and Payment

Plans and Pricing

PicGallery offers free and paid subscription plans. Features, storage limits, and pricing for each plan are described on our pricing page. We reserve the right to modify pricing with reasonable notice.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Free Trial

We may offer free trials of paid features. Unless you cancel before the trial ends, you will be automatically charged for the subscription.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by PicGallery and are protected by copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of results obtained from the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICGALLERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any damages resulting from User Content or third-party conduct

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PicGallery, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
